Creditors Rights
Our creditors rights practice group represents both corporate and individual lenders in creditor rights matters throughout the state of Florida.
This practice includes the representation of both national banks and state chartered financial institutions, as well as insurance companies, trusts and individual lenders. Although our creditors rights group routinely handles all matters associated with debtor-creditor relationships, some represented areas include complex commercial foreclosure including shopping centers, office buildings, apartment complexes, healthcare properties, and agricultural properties.
Areas of emphasis also include creditor-related remedies such as replevin, garnishment, attachment, eviction, the domestication and enforcement of judgments, prosecuting and defending fraudulent transfer claims, pursuing the appointment of receivers, challenging tax assessments and handling contested bankruptcy hearings and trials.
Finally, the firm’s creditors rights practice group has experienced defending banks and other lenders against claims of lender liability.
